Important Information and Resources for the Newmarket Criminal Court

The Newmarket Courthouse serves as the regional courthouse for all of York Region. This means that all criminal matters for individuals charged in York Region are handled at this location. Whether a person is charged with a serious or minor criminal offence, their case will be heard here. Both the Ontario Court of Justice and the Superior Court of Justice have courts located at this site.

Appearing in Court

All first appearances for individuals charged with a criminal offence are conducted virtually unless otherwise ordered by the Court. Valuable resources on how to attend court can be found on the Ontario Court of Justice website. This site provides information on court commencement times, different schedules for those with lawyers and those without, and options for joining by phone. Note that there are separate schedules for adult, youth, and domestic violence offences.

In these types of courts, lawyers will attend first. People who have hired lawyers will usually have their lawyers attend on their behalf. Once all the lawyers’ matters are complete, the court will move to the self-represented list. Do not feel intimidated if you are self-represented at these early stages in the proceedings. As the case progresses towards negotiations and litigation, the role of lawyers becomes more significant. These first-appearance courts are highly administrative in nature. If a person wishes to proceed without a lawyer, they will need to attend the Judge-led Intensive Case Management Court for a thorough briefing on what to expect and the issues in dispute. Once everything is ready to proceed, a lawyer or self-represented accused will attend the “Trial Readiness Court” to confirm the trial date.
